NNPC audit reveals double payment of subsidy on petrol & kerosene, spent N3.65trn without approval

The just released audit report by PricewaterHouse Coopers PWC on the financial management of the NNPC has revealed that there were many cases of duplicated subsidy payment by the NNPC to many oil marketers between 2012 and 2013.

According to the report, payment of subsidies for petrol (PMS) and kerosene (DPK) between January 2012 and July 2013 when investigated had a difference of $980 million (about N195 billion) due to duplicated payments.
“Our review of the subsidy documentation revealed that the subsidy due to NNPC between January 2012 and July 2013 on PMS and DPK import was $8.99billion compared to the $9.97 billion stated by the Reconciliation Committee.
The difference was due to the following: Exclusion of October 2011-December 2011 subsidy claims of $1.2billion. This does not relate to the review period of January 2012 to July 2013; $0.13billion increase in PMS subsidy claimed for the 19 months period, $0.09billion increase in DPK subsidy claimed for the 19 months period; duplicated discharges noted in subsidy computations Our examination of the PMS and DPK import verified by PPPRA revealed that some discharges were apparently verified and subsidy advised to NNPC more than once,” the report stated.

According to Leadership, the report showed NNPC spent $18.53billion (or N3.65 trillion) as operational costs without a duly approved budgetary allocation. The report also indicated that the total gross revenues generated from the federal government crude oil lifting between January 1, 2012 and July 31, 2013 was $69.34 billion and not $67 billion as earlier stated by the federal government’s Reconciliation Committee.

The report also stated it was unable to verify the exact unremitted revenues accruing to the Federation Accounts as it did not have access to NPDC’s full account. The Nigerian Petroleum Development Company is a subsidiary of the NNPC. “We did not have access to NPDC’s full accounts and records and we have not ascertained the amount of costs and expenses which should be applied to the US$5.11billion Crude Oil revenue (net of royalties and PPT paid) per the NPDC submission to the Senate Committee which should be considered as dividend payment by NPDC to NNPC for ultimate remittance to the Federation Account.

Between 12 January and 29 January 2015, NNPC provided transaction documents representing additional costs of $2.81 billion related to the review period, citing the NNPC Act LFN No 33 of 1977 that allows such deductions. Clarity is required on whether such deductions should be made by NNPC as a first-line charge before remitting the net proceeds of domestic crude to the Federation Accounts. If these are deemed not to be valid deductions, then the amount due from NNPC would be estimated at $2.07 billion (without considering expected known remittances from NPDC) or $4.29 billion (if expected known remittances from NPDC are considered).”

The forensic audit became necessary following a letter in September 2013 by the former governor of the Central Bank of Nigeria (CBN), Sanusi Lamido Sanusi, to President Goodluck Jonathan stating that from January 2012 to July 2013, NNPC lifted $65 billion worth of crude on behalf of the federal government but remitted only $15.2 billion into the Federation Accounts, with $49.8 billion as outstanding to the federal government. On December 13, 2013, the NNPC responded that no money was missing.

A Reconciliation Committee comprising representatives of the CBN, NNPC, Department of Petroleum Resources (DPR), Federal Inland Revenue Service (FIRS), Office of the Accountant General (OAGF), the Budget Office of the Federation, Federal Ministry of Finance and the Federal Ministry of Petroleum Resources was set up On December 18, 2013, the Reconciliation Committee, in its report, estimated the unremitted funds at $10.8 billion while the CBN said it was $12 billion.

The CBN on February 4, 2014 informed the Senate Committee on Finance that the NNPC needed to account for $20 billion as the CBN could only confirm receipt of $47 billion of $67 billion revenue. On February 13, 2014, the NNPC provided explanations of the $20 billion shortfall while the finance minister and coordinating minister for the economy recommended an independent forensic audit. On June 5, 2014, PwC was appointed by the office of the Auditor General of the Federation (OAuGF) to conduct a forensic audit into the allegations

Finally, It's Time For Us To Stop The Petrol Subsidy


The whole issue of fuel subsidy has come to be perceived as one huge scam the government is not coming clean on. The skewed policy moved the country to near fiscal collapse between 2011 and 2012. Between 2008 and 2010, the federal government paid a total sum of N1.2trillion, an equivalent of $8billion on subsidy at the 2011 exchange rate. The fact of the matter is that subsidy creates soft money for some smart persons and the privileged in the society.

The result is the creation of billionaires that have negligible impact on the economy, because they do not have the capacity to create jobs or employment or add value to production. While they make humongous wealth from subsidy, the rest of society suffers from infrastructural and institutional decay, especially in the social sectors. 

Subsidy withdrawal is a far-reaching economic restructuring strategy that requires tough political will and an even greater measure of toughness to ensure that the savings from its removal are judiciously utilised to meet the needs of the people. It is not enough to announce its removal, government must engage in a communication strategy that can convince all stakeholders.

The need to do away with subsidy must be obvious to all by now; presently the cost varies with location, going as high as N140 per litre in the southeast and far north. Though there are challenges associated with it, its greatest handicap lies in the lack of trust for the government by the people. So long as government insists on running a closed shop on the issue, so long will there be perpetual suspicion of its policies, no matter how well intended. 

The supposed subsidy on fuel is a rip-off. Given the state of our poverty-ridden economy where more than half of the population lives below the poverty line, 38 per cent of the women have no education and less than 10 per cent attended school beyond secondary level, it is important to muster the political will necessary to pronounce and execute such delicate policy thrust.

We tout the fact that Nigeria is the largest economy in Africa now. It is also the 10th largest oil producer, even though much of it is lost to oil theft and bunkering, which is to say that this giant has not done well for itself. We have lived with economic recklessness and excesses for too long; there is the need for a rethink of the nation’s economic situation. This is the task before the outgoing and incoming ministers of finance and other economic advisers. 

The reality of our economic situation is far from rosy and this must be properly communicated and addressed. This fuel subsidy only benefits a negligible percentage of the populace while impoverishing the majority. This is the predicament we are faced with and which the incoming administration must address head on.

President-elect, General Muhammadu Buhari says the Boko Haram will be denied a recruitment base the moment our local communities realize that its claim to being a religious group is nothing but a fraud.

"The fraud called Boko Haram can be defeated by denying it a recruitment base. No religion allows for the killing of children in school dormitory, in markets and places of worship.

"They have nothing to do with religion. They are terrorists and we are going to deal with them as they deal with terrorists anywhere,"
General Buhari told visiting leaders of Nassarawa State who came to congratulate him on his emergence as President-elect.

Buhari said he is greatly pained by the destruction of schools in the North-eastern part of the country, an action he said could deny thousands of youngsters access to education and a better future unless something was done urgently to avert this tragedy.

"The worst thing anybody can do is to deny children access to education. That will be destructive to their lives and we are not going to allow that to happen," the President-elect assured.

He announce that his government will help the states to get more money to improve infrastructure by ensuring that all federally collectible revenues are paid directly into the federation account and each tier of government given its due share.

"As at now, the government does not even know how many revenue accounts it has. We will give all the tiers what is due to them but will hold them to be accountable as we would the federal government."

Ondo State Deputy Governor’s Impeachment, A Joke


Alhaji Ali Olanusi has described his removal by the Ondo State House of Assembly as deputy governor as a huge joke. He spoke through his lawyer, Oluwole Kayode, hours after the Commissioner for Agriculture, Lasisi Oluboyo, was sworn in as the state’s new deputy governor.

Olanusi’s travails began a month ago when he dumped the PDP for the APC. In condemning his impeachment, he reminded the lawmakers of an April 23 court order that the status quo be maintained in respect of his office.
He said, “Another action in respect of the same office and the impeachment process is pending in court and will come up on May 7, 2015. 
“I think public office holders and people who are put in positions to defend the Nigerian constitution must be law abiding. 
“In the light of this disobedience to a court order and the impunity displayed in the course of the impeachment proceedings, the deputy governor is on solid ground. The action is illegal and a juge joke.”

Olanusi’s impeachment followed the submission on Monday of a report by the seven-man panel constituted by Chief Judge Olasehinde Kumuyi.
After considering the report on Monday, the Majority Leader of the Assembly, Ifedayo Akinsoyinu, moved the motion for the impeachment of the deputy governor.

Akinsoyinu based his motion on the report which indicted Olanusi of the allegations of gross misconduct that was leveled against him by the assembly.

The process for the illegal impeachment of the deputy governor lasted barely a week with the service of the impeachment notice on him. The case comes on in court on May 7.

EXPOSED: $18.53billion Oil Money Was Secretly Deducted


So, Sanusi Lamido Sanusi was right about the stealing of Nigeria's money through NNPC? A forensic audit of Nigeria’s state oil firm released has confirmed the accusation by Emir Sanusi that the NNPC withheld about $20 billion that it ought to have remitted to the national treasury.

The report ordered released by President Goodluck Jonathan, more than two months after it was submitted by PriceWaterHouseCoopers confirmed that the NNPC illegally expended $18.53bn on operational costs, kerosene and petrol subsidies, without any form of official authorisation.

Sanusi had told a Senate committee in 2014 that NNPC received $67bn and handed over only $47bn.

Part of the cash was also withheld by an NNPC subsidiary, without National Assembly authorisation.
According to Reuters, although the audit found that the firm overpaid the state by almost $750 million, within the 19 months probed, it recommended a refund of $1.5 billion to government coffers. The audit covered January 2012 to July 2013.

Outgoing Nigerian President Goodluck Jonathan released the audit days after his elected replacement, Muhammadu Buhari, pledged to probe the allegation all over again and crack down on corruption in the energy company once in office.

The probe of Nigeria National Petroleum Corporation’s (NNPC) books was instituted last year after former central bank governor Lamido Sanusi said the firm had withheld $20 billion in oil revenue from government coffers, jeopardising the country’s finances.

After Sanusi's allegations, Jonathan publicly dismissed the claim and replaced Sanusi, saying the banker had mismanaged the central bank’s budget. Sanusi has since become Emir of Kano, the country’s second-highest Islamic authority.

The PwC audit, however, said NNPC and its upstream subsidiary, the Nigerian Petroleum Development Company, should hand over $1.48 billion arising from unsubstantiated costs, duplicated subsidy claims and computation errors.

The report also recommended an overhaul of how NNPC is run.

“The NNPC model of operation must be urgently reviewed and restructured, as the current model which has been in operation since the creation of the corporation cannot be sustained,” it said in the 200-page document.

An earlier one-page version of the report, which had been due out in September, was released in February.

The affair has caused consternation in a nation long accustomed to reports of grand graft in Africa’s largest oil producer.

Analysts say Buhari, 72, managed to oust Jonathan in elections last month because voters believed he would tackle graft in Africa’s largest economy.

Buhari has vowed to recover our money from the looters, including all the properties to buy with them.

Maybe I should attempt to open our eyes just a little to what is actually going on: 'Buhari bans AIT from covering his activities'. This is nothing for you to rejoice about that AIT sponsored hate campaign and so it's a good response. No! It isn't. It is just a true reflection of the 1984 hatred for critics and the press. Indeed, you may repackage a despot, but he is what he is.
I laugh when I remember his words at Chatham house: "so I present to you, a former dictator and a 'born-again' democrat'. Like really? Do you realize that one Cardinal part of this democracy is the freedom of the press?  Perhaps he understands the role of the media in bringing down GEJ and maybe scared of same.

Let me take you back a little, do you know the APC legislators, last year sponsored a bill to control the press? to be specific, social media?  Do you realize that severally as a dictator, Mr. President-Elect called the media, 'a distraction'.

What then is the lesson?

While I do not subscribe to ANY form of unprofessionalism in the media, this is democracy, you can sue for defamation, except of cos you think they are saying the truth. Further you could prosecute for sedition (that's what I'll do to Sahara reporters if I were GEJ). You do not blacklist the media.  It only starts with AIT and then possibly it will spread to other channels. Then we would have a 'controlled media'.

But then again, let this cloud that is gathered yield us some fruits, 'cos the NextGeneration is patiently waiting to kick all of you out.  Just wait and see!
